Lost World Adventures – General Terms and Conditions


1. ACCEPTANCE OF THE CONTRACT
Upon purchase of a tour package, the terms and conditions set forth herein become a binding contract between the traveler (“Client”) and Lost World Adventures, Inc. (“LWA”). Acceptance of this contract occurs upon receipt of a deposit or other electronic confirmation, including online acceptance or payment. Client represents that the itinerary has been reviewed and meets their expectations and requests. This contract shall be governed and performed under the laws of the State of Georgia.

2. DEFINITIONS
a. The Tour Package consists of the itinerary prepared by LWA and vouchers for prepaid travel services. In the event of a conflict between promotional materials and the itinerary, the itinerary shall control.

b. Travel arrangements are not confirmed until required deposits are received and written confirmation is issued by LWA.

c. Hotel accommodations shown are representative; comparable accommodations may be substituted.

d. Transfers refer to shared or private transportation as specified in the itinerary.

3. RESERVATIONS AND PAYMENT
A deposit is required to reserve space on any trip.  Planning and service fees are non-refundable once work has commenced.  Full payment is due no later than 60 days prior to departure unless otherwise stated. Failure to make timely payments may result in cancellation without refund. Payments may be made by credit card, check, or bank transfer.

4. PARTICIPATION AND FITNESS TO TRAVEL
Client is responsible for selecting a trip appropriate to their health, abilities, and interests. Client acknowledges participation involves inherent risks and agrees to execute LWA’s Travel Waiver & Assumption of Risk Agreement.  LWA reserves the right to decline participation for reasons affecting the safety or enjoyment of the trip.

5. PRICE AND CHANGES
Prices are based on current costs and are subject to change prior to full payment due to currency fluctuations, fuel surcharges, taxes, or supplier increases. Airfare is not included unless expressly stated.

6. CANCELLATION POLICY
Cancellation penalties apply as follows:
More than 60 days prior: $500 per person
30–59 days prior: 50% of trip cost
Less than 30 days or no-show: 100% of trip cost

Supplier cancellation terms may override LWA’s policy. Travel insurance is strongly recommended, including medical evacuation coverage.

7. REFUNDS
Unused services are non-refundable.  Planning fees and service charges are non-refundable.  Refund requests must be submitted in writing within 30 days of return.

8. CHANGES OR FORCE MAJEURE
LWA reserves the right to modify or cancel services due to events beyond its control, including but not limited to natural disasters, public health emergencies, border closures, strikes, or government actions. In such cases, LWA’s liability is limited to recoverable supplier refunds.

9. CUSTOM ITINERARIES
Custom itineraries are prepared based on information provided by Client.  Failure to request changes in writing constitutes acceptance.  Changes after confirmation may incur service fees and price adjustments.

10. NO WARRANTY
LWA makes no guarantees regarding weather, wildlife sightings, or specific experiences.

11. LIMITATION OF LIABILITY AND RELEASE
LWA acts solely as a travel planner and is not responsible for acts or omissions of independent suppliers.  LWA shall not be liable for indirect, incidental, or consequential damages. Client releases LWA from claims arising from delays, injuries, illness, or losses beyond its control.

12. GOVERNING LAW AND VENUE
This agreement shall be governed by the laws of the State of Georgia. Venue for any dispute shall be the courts of the State of Georgia.
